Terms of Service
These terms govern access to and use of the tools published at hushcrasher.com/tools (the "Service") by HUSHCRASHER, a French société par actions simplifiée with a share capital of €1,000, registered in Paris under number 999 215 908, whose registered office is at 60 rue François 1er, 75008 Paris, France ("Hushcrasher", "we"). By using the Service you accept them. If you act on behalf of a company, you confirm you may bind it.
The Service and our reports are offered to businesses and professionals only. By using the Service or ordering a report you confirm that you act in the course of your trade, business or profession. If mandatory consumer law nevertheless applies to you, nothing in these terms limits the rights it grants you.
Definitions
- "Tools": the Steam Regional Pricing tool, the Game Budget Benchmark and any tool we add to the Service.
- "Customer", "you": the company or professional using the Service.
The Service
The Tools provide market data and statistical estimates for video game professionals. The Game Budget Benchmark is in alpha: its outputs are indicative ranges produced by a statistical model trained on a limited panel of games. They are not a quote, a forecast of your costs, or financial, accounting or investment advice. You remain solely responsible for decisions you take using the Service.
We provide the Service on reasonable efforts, without a guaranteed uptime, and we may change, suspend or retire features at any time.
Reports
These terms also cover the reports we sell at hushcrasher.com/reports: custom reports made to order for a project, such as the Comparable Games Market Analysis, and published reports, including pre-orders, such as The State of Profitability in the Video Game Industry.
Ordering and payment. A custom report is ordered by email. We confirm the order by email and send an invoice or a payment link. Prices exclude VAT; EU businesses with a valid VAT number are invoiced under the reverse-charge mechanism. Published reports are bought online through Paddle, our reseller and merchant of record, which charges the price and applicable taxes and issues the invoice.
Delivery. A custom report is delivered by email within the lead time we agree with you when you order, counted from payment and from receipt of the information we need. A pre-ordered report is delivered by email on release.
Licence. A report is licensed for internal use within the buyer's company. You may share a custom report about your own project with publishers and investors assessing it. Any other redistribution, resale or publication of a report, in whole or in substantial part, requires our written consent. Short quotations crediting "Hushcrasher" are allowed.
Refunds. A custom report can be cancelled with a full refund until we start working on it. Once delivered, it is not refundable, but we send a corrected version if it contains a factual error. A pre-order can be refunded on request at any time before release, and if a pre-ordered report is not released by the date stated on its page (31 March 2027 for The State of Profitability in the Video Game Industry), we offer every buyer a refund. Confidentiality. The project details you send us to produce a custom report are kept confidential and used only for that purpose.
Nature of the content. Reports contain estimates produced by our models. They are information only, not investment advice, and they do not guarantee revenue, returns or any other outcome.
Acceptable use
You agree not to:
- scrape, crawl, bulk-download or systematically extract data or outputs from the Tools;
- resell, sublicense or provide the Service or its outputs as a service to third parties;
- reverse engineer the models, or use the outputs to build a competing product or train a competing model;
- circumvent technical restrictions or rate limits;
- use the Service unlawfully or in a way that harms it or other users.
Intellectual property and outputs
The Service, our reports, their content, code, models, datasets and branding are owned by Hushcrasher or its licensors and protected by intellectual property law; reports are licensed as set out in the Reports section. Subject to these terms, you may use the outputs you obtain from the Tools (figures, charts, exports) internally, in pitch decks, publisher or investor materials, and publications, provided you credit "Hushcrasher" as the source and do not present outputs as a guarantee. Any feedback you send may be used freely to improve the Service.
Personal data
We process personal data as described in our Privacy Policy.
Warranties and liability
The Service and our reports are provided "as is". To the extent permitted by law we exclude all implied warranties, including accuracy, fitness for a particular purpose and uninterrupted availability. Nothing in these terms limits liability for death or personal injury, fraud, gross negligence or wilful misconduct, or any liability that cannot be limited under applicable law.
Subject to the above, our total liability arising out of the Service in any 12-month period is limited to €100, our total liability arising out of a report is limited to the price paid for that report, and we are not liable for indirect or consequential losses, loss of profit, revenue, data or business opportunity, including losses arising from decisions taken on the basis of the Tools' outputs or of a report.
Suspension and termination
We may suspend or terminate access, after notice where practicable, in case of breach of these terms or security risk. You may stop using the Service at any time. The acceptable use, intellectual property and liability sections survive termination.
Changes to these terms
We may update these terms. Material changes are announced on this page at least 30 days before they take effect; continued use after that date means acceptance.
Governing law and jurisdiction
These terms are governed by French law. Any dispute relating to them or to the Service is submitted to the exclusive jurisdiction of the Tribunal des activités économiques de Paris, notwithstanding multiple defendants or third-party proceedings.
